Right of Withdrawal
Right of Withdrawal for Consumers
Consumers generally have a statutory right of withdrawal of 14 days when purchasing digital products. However, this right may expire once the execution of the contract has begun – for example, by providing a download – and the consumer has given their explicit prior consent.
Exclusion of the Right of Withdrawal for Digital Content
In accordance with § 356 (5) of the German Civil Code (BGB), the right of withdrawal does not apply to a contract for the supply of digital content (such as e-books) not supplied on a physical medium if:
– the seller (that’s me) has begun performance of the contract,
– after the consumer has expressly consented to the start of performance before the end of the withdrawal period,
– and the consumer has acknowledged that they lose their right of withdrawal once performance has begun.
Notice:
By purchasing my digital product, you explicitly agree that the download will be made available immediately after purchase, and you thereby waive your statutory right of withdrawal.
